Labor Law

The Dominican Labor Code (Law 16-92) requires that at least 80% of a company’s workforce be Dominican nationals, with exemptions permitted only for managerial, technical, or highly specialized positions. The law also prohibits hiring foreigners under a tourist visa; all foreign employees must hold a valid work permit issued by the Immigration Department and the Ministry of Labor.

We provide comprehensive labor law support for both local and international companies, including:

  • Drafting and adapting employment contracts in compliance with Dominican labor regulations.
  • Employee registration with the Ministry of Labor, TSS, CNSS, and the Tax Authority (DGII).
  • Work permit processing and immigration compliance for foreign staff.
  • Compliance with statutory benefits, such as vacation, Christmas salary, severance, profit-sharing, and all legally mandated payments.
  • Preventive labor audits to reduce legal exposure, avoid fines, and prevent operational disruptions.
  • Development of internal policies, employee handbooks, compliance manuals, and disciplinary procedures.
  • Guidance on terminations, resignations, layoffs, and severance calculations, ensuring full compliance with Dominican law.
  • Representation in labor disputes before courts, the Ministry of Labor, and mediation processes.
  • We handle the registration of both Dominican and foreign staff in the Social Security System, ensuring proper payment of labor-related taxes and full regulatory compliance.

Contact us to ensure your company remains fully compliant with Dominican labor law. We will assist with contract preparation, work permits, regulatory filings, labor audits, and any employment-related matters.
